Lawsuit filed after 2021 crash that killed Drury student-teacher

A wrongful death lawsuit has been filed by the widower of a Drury student-teacher after a 2021 crash that resulted in her death.

What We Know: According to court records, Joshua Luna, the surviving husband of Mercedes Luna, has filed a lawsuit against Marjorie Black Dewitt in Greene County Circuit Court for her involvement in the crash.

In May of 2021, Dewitt was attempting to pass a FedEx truck on State Highway 125 and forced Mercedes to swerve to avoid hitting Dewitt head-on. Mercedes lost control of her vehicle and was hit by the FedEx truck.

It wasn’t until November that Dewitt turned herself into police with her attorney, but pleaded not guilty to any charges at the time.

In July 2025, Dewitt entered an Alford Plea for first-degree involuntary manslaughter and leaving the scene of an accident resulting in death and was sentenced to 30 days in jail.

What It Means: The lawsuit, filed by Joshua Luna, accuses Dewitt of being negligent and careless while operating a motor vehicle.

The petition does not include a specific monetary amount but asks for compensation for damages, losses, and funeral expenses.
