Man Sues Silver Dollar City Over Train Derailment

A man has filed a lawsuit against the Herschend Family Entertainment Corporation, the owner and operator of Silver Dollar City, alleging a train derailment in October 2022 left him with permanent injuries.

The petition was filed on Tuesday (July 14) in Stone County Circuit Court and names Timothy Taylor as the plaintiff. The lawsuit alleges the train was in dangerous condition at the time of the incident. The train at Silver Dollar City dates back at least to World War Two and was once used to carry German troops.

According to the petition, the springs on the right side of carriage #3 were taller than those on the left side. The carriage side bearings showed uneven wear and the track rails were misaligned with the ties spaced inconsistantly and the train had loose joint bolts.

Taylor alleges the company knew- or should have known about those conditions.

Taylor has underwent a 3-level anterior cervical fusion surgery and had right shoulder arthroscopy, including injuries to his neck, right shoulder, back and body as a whole with fractured vertebrae and has undergone injections, physical therapy and pain management.

The petition states the injuries are permanent and progressive.
